U.N.O! HOPES BELIED

On the one hand, we have a glorious and prideful history of struggle for freedom at our back and on the other hand we are the victims of apathy by the families of the globe and the UNO, with the result, the Indian Govt. feels encouraged and happy to use brute force against the people their life, honour economy progress and prosperity. The ill fated Pakistani resolutions of December 1993 in General Assembly and March 1994 in UNCHR (Geneva) on Kashmir, speak a lot on the subject. It is also sad, that the European Union also abstained and kept mum, which had arranged Brussels moot on Kashmir in 1993. More sad to discover, that first the civilised countries seemed indifferent to our objectives under UNO charter and now they are not ready to stand by our side on the most popular western subject i.e. the human rights violations.

It is the cold shoulder of the world body and global powers towards our plight that the occupation troops of India have fallen in deep moral degradation in the held region of Kashmir. India as yet has not been conveyed seriously this. message by the world that no 'solution of Kashmir will emerge out by terrorising the people under genocide, rape and imprisonment. Therefore, she believes in these very inhuman and terrific methods and practises more and more brute force against our people. India fails to understand that the devotion and commitment of Kashmiris to their national cause is deeper than the Pacific ocean and loftier than skies. It is sad and strange that continuous heinous crimes by India against humanity in Kashmir evoke no major response, barring a few in the west, who champion movements of freedom, democracy and human rights elsewhere in the world and among the Muslim Govts; who believe in Islamic fraternity. Some western powers argue that U.N. force can be used against a state only if that state threatens the sovereignty of any other sovereign state and since in their opinion Kashmir was not a sovereign country at the time of partition of India in 1947, therefore no similarity exists between Kuwait and Jammu and Kashmir. If this is the argument then how they will explain or defend the dismemberment of Pakistan with the active support of Indian troops in 197i and annexation of Bosnian lands by Serb aggressors. Pakistan and Bosnia are members as independent sovereign republics of United Nations Organization. Again, if the world body has no justification to interfere where basic human rights or the right of self determination of a non sovereign country, is infringed by some sovereign state then what remedial measures and by whom will be taken against an aggressive sovereign state particularly When the case belongs to the UNO by virtue of various resolutions as passed by it. Resolutions of UNO on Kashmir and solemn promises made by India and Pakistan with the people of Kashmir prove clearly that the status of Kashmir is not a settled matter and UNO is duty bound to look after our interests till the final disposal of Kashmir issue. Yet, it is another-tragic episode of U.N.O. that it has not demonstrated global will, courage and fairness of mind to protect the sovereignty, honour and property of Bosnia Muslim republic from the onslaught and rampage of Serb aggressors and criminals. Nor the world body has allowed Bosnian Muslim Republic to protect her lands and people from Serb aggressors.

Kashmir stands on a unique pillar, the state has neither seceded from any federation nor ceded her rights to any sovereign state. What ceased to exist as a unified country on 14 August 1947 by virtue of the act of independence was the Indian subcontinent, which got divided into two sovereign republics and with the result, Jammu and Kashmir emerged as a new question, a new entity whose onus shifted to UNO, because claims and counter claims of India and Pakistan on the ex-princely state were made conditional and subservient to the freely expressed will of the people of Kashmir. In other words UNO recognised right of Kashmiris to pronounce a judgement on their future political status through a free, fair and impartial plebiscite under its auspices. Therefore, under the conditions of the charter and the resolutions of the Security Council, the world body has the responsibility to look after the people of Kashmir and impose deterrents against infringement of their basic human rights by India or Pakistan, till the final disposal of Kashmir, according to the wishes of the people of the state. The core question which needs to be answered and addressed by the world body is that if a Govt. is responsible to look after the rights of her people, who will take care of the rights of a disputed region, whose political destiny remains unsettled under international laws particularly when the people and their colonial rulers are at war with each other, the people stand for freedom and rulers insist on their subjugation and submission as slaves. Under such circumstances UNO is the only organization which is duty bound to take care of oppressed people from being wiped out, till their political future takes sound and definite shape according to the urges and aspirations of the majority of the population. United Nations has already accepted a role in Kashmir under its various resolutions and it should not hesitate to play its due role in the army torn occupied region. Let us not subscribe to the preposition that UNO should go and sit down in Kashmir for a decade or half without taking into confidence freedom fighters or without considering the implementation of Kashmir resolutions in toto or in some reviewed form, because it may be equivalent to delay in justice.

During the last 48 years we opposed and resisted each and every step that India took to merge Kashmir with her dominion and thousands of Kashmiris lost their precious lives in their political struggle against the Indian aggressors and neo-imperialists. In the last four years of grand but perilous struggle of life and death, our people have made explicit expression of their faith and ideology and proved their metal well as insurmountable. This is how the people of Kashmir are the most basic and important factor of Kashmir issue and it is neither India nor Pakistan 'nor any other state which can deliver judgement in this case on behalf of Kashmiris. The UNO despite its resolutions on Kashmir kept mum during all these years, but, the people of Kashmir despite their belied hopes look to the world forum and ask it to invoke her resolutions on Kashmir as it (UNO) did in the case of Kuwait. UN also helped many oppressed people in accordance with the principles of nationalism and right of self-determination. It upheld national and Islamic independence movement of Afghans against Soviet Russia. The world body recognised secession of central Asian states from Soviet Russia. It arranged and supervised plebiscite in Eriteria against Ethopia. Therefore the world forum must have no hesitation in fulfilling its explicit promise made to the people of Kashmir. It is also the duty of UNO to sand in explicit terms a message to India that Kashmir is a question of great political and national rights between UNO and India and hence its solution is outside the preview of Indian constitution which deals with the state and inter state disputes only. Kashmir question cannot be solved nor peace can be restored unless the Indian Govt. withdraws her troops from Kashmir and gives rights of self determination to the people of Kashmir as guaranteed under the charter and the resolutions of the UNO.

The problem before the people of Kashmir is that while they face unlimited and unparalleled animal brutality by India the United Nations Organization being responsible for protecting different nations and people of the world, is not initiating quick steps to implement its resolutions and stop India from further annihilation of Kashmir. Besides this, the Muslim leadership all over the world has lost contacts with their public. The ruling elite has also drawn long barriers and they are hiding from the people as well as from God. Global leadership of Muslims needs dedication, co-ordination and co-operation on the foot steps of Prophet (P.B.U.H.) to solve national or international problems of Ummah.

It is the faith and determination of Kashmir, that has shaken India politically, economically and psychologically. It is the result of our just and fair struggle that has won the sympathies of many Indian journalists, writers and jurists and some others having human hearts in their bodies. But the perpetual subjugation and oppression in Kashmir is the virus pronounced by chauvinism, communalism and expansionism spread everywhere by rabid Hindu communalist. It is here that all, the civilised nations of the world should come forward and force India to accept the demand of Kashmir. On the Indian side, right thinking personalities can play their role and mobilise their own public opinion to support a just and peaceful approach to the question of Kashmir. Both the UNO and saner people of India will have to prevail on fanatic Hindu leadership and demonstrate enough courage and wisdom to save millions of people from the disaster of war.

At the same time, the sympathisers of humanity around the world should never ignore vested elements in the sub-continent of India, Pakistan and both parts of Kashmir, who do not wish to see a just solution of Kashmir in the near future. It is due to the selfish elements and exploiters that apparently, no end to the sufferings of the Indian occupied Kashmir seems in sight. Frankly speaking, the poor people of Kashmir are the only lot who yearn for an early solution of Kashmir, because it is the unfortunate population which faces the brunt of Indian brutal colonial rule. But, the fact is that solution will not emerge out of bilateral talks either between India and Pakistan or between India and Kashmir. Failure of Tashkent and Simla Agreements on the one hand and Delhi accords of 1952 and 1975, between India and Abdullah on the other, show how events should be shaped in future. Kashmir is a question of direct conflict between three major parties of India, Pakistan and Kashmir. But it is a question of life and death, inalienable rights, urges and aspirations of millions of Kashmiri Muslims, whose hearts bleed and whose honour and pride is being ruined and desecrated by India simply for their love of freedom. So our struggle of independence is a war against lusty Indian expansionist, who humiliates our just human aspirations. No freedom loving society on earth can decline to share with us in our urges and feelings.
